FDA WARNING_LETTER - A TRUE MOVE LLC - October 13, 2023

On December 18, 2023, the FDA issued a Warning Letter to A True Move LLC following a Foreign Supplier Verification Program (FSVP) inspection conducted from October 12-13, 2023. Previous inspections occurred in August 2017 and April 2023. The inspection found the company non-compliant with 21 CFR part 1 subpart L and section 805 of the FD&C Act, which require importers to verify that imported food meets U.S. food safety standards.

The primary violation identified was the failure to develop, maintain, and follow an FSVP for any imported foods, as required by 21 CFR 1.502(a). The company's November 2, 2023 response, mentioning consultation with a third party for monitoring and FSVP plan development, was deemed inadequate due to a lack of supporting documentation or a timeframe for completion.

The FDA requires the company to register its facility within 30 working days. Failure to address these violations may result in refusal of admission for imported foods under section 801(a)(3) of the FD&C Act, detention without physical examination (DWPE) under Import Alert # 99-41, and prohibition of importation under section 301(zz). A written response detailing corrective actions, including documentation and timelines, is required within fifteen working days
