The inspections revealed that the company is in significant violation of the Federal Food, Drug, and Cosmetic Act because they failed to establish the required Foreign Supplier Verification Program (FSVP) for several imported items, including squash, cucumbers, and husk tomatoes. Under current food safety regulations, importers must implement risk-based activities to ensure that foreign suppliers meet U.S. safety standards, particularly regarding the growing and harvesting of produce. Because Baja Fresko failed to develop or maintain these verification programs, the FDA has warned that their imported goods may be refused entry into the United States or held at the border without physical examination. To resolve these issues, the company must provide a written response within 15 working days detailing their corrective actions. This response must include documentation of their newly developed safety programs and evidence of their implementation. Failure to address these concerns may lead to further legal or regulatory enforcement action.
