FDA WARNING_LETTER - Bill's Quick Mart, Inc.

The FDA Center for Tobacco Products issued a Warning Letter to Bill's Quick Mart, Inc. after reviewing their website, http://www.billsquickmart.com, and finding that smokeless tobacco products were offered for sale in the U.S. without required health warning labels. The products, including Copenhagen Snuff, Grizzly Long Cut Wintergreen, and Skoal Long Cut Wintergreen, are considered misbranded under sections 903(a)(1) and/or 903(a)(7)(A) of the FD&C Act.

The violations stem from the failure to include any of the mandatory health warning statements required by Section 3(b) of the Comprehensive Smokeless Tobacco Health Education Act of 1986 (15 U.S.C. § 4402), as amended. These warnings include statements about mouth cancer, gum disease/tooth loss, the product not being a safe alternative to cigarettes, and addictiveness. The letter also noted the requirement for quarterly rotation of warning label statements on advertising, per 15 U.S.C. § 4402(b)(3).

Bill's Quick Mart, Inc. is required to immediately correct these violations and ensure all tobacco products, labeling, and advertising on their website and other media comply with the FD&C Act. Failure to comply could result in civil money penalties, no-tobacco-sale orders, criminal prosecution,
