FDA WARNING_LETTER - cigarettesbuyer.com - May 24, 2012

The FDA's Center for Tobacco Products issued a Warning Letter to CigarettesBuyer.Com on March 23, 2012, following a review of their website, cigarettesbuyer.com. The FDA determined that the company was offering cigarette products for sale to U.S. customers that are subject to FDA jurisdiction under the FD&C Act.

The letter identified several cigarette products as either adulterated under section 902(5) or misbranded under section 903(a)(1) of the FD&C Act. Specifically, Kiss Fresh Apple Superslims, Kiss Strawberry Superslims, Rich Aroma Apple, Rich Aroma Rum & Cherry, Esse Aura Green Apple Super Slims, and Esse Aura Pink Strawberry Super Slims cigarettes were found to be represented as containing artificial or natural characterizing flavors.

Under section 907(a)(1)(A) of the FD&C Act, cigarettes containing a characterizing flavor (other than tobacco or menthol) are prohibited. If these products indeed contain such flavors, they are adulterated. Alternatively, if they do not contain these flavors, their labeling is false and misleading, rendering them misbranded.

CigarettesBuyer.Com was instructed to immediately correct these violations and ensure all tobacco products comply with the FD&C Act. Failure to comply could result in further FDA action, including civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, and/or injunction
