FDA WARNING_LETTER - Discover Health, LLC d/b/a Discover CBD and Strain Snobs - November 21, 2023

The FDA issued a Warning Letter to Justin L. Hays regarding products sold on discovercbd.com and activecbdoil.com, the latter being the U.S. distributor for Active CBD Oil. The review, conducted from June to August 2023, identified multiple violations of the Federal Food, Drug, and Cosmetic Act (FD&C Act).

Several products, including "Active CBD Oil – Full Spectrum Distillate Cartridge" and "Strain Snobs Δ8 THC Salve," are deemed unapproved new drugs under sections 505(a) and 301(d) of the FD&C Act, and misbranded under section 502(f)(1) for lacking adequate directions for use. These products are marketed with drug claims, such as treating opioid addiction, without FDA approval.

Additionally, products like "Active CBD Oil Infused Coffee" and "Strain Snobs™ Delta-8 Plant-Based Gummies" are considered adulterated human foods under section 402(a)(2)(C)(i) and prohibited under section 301(ll) because they contain unapproved food additives (CBD and Delta-8 THC), which are not generally recognized as safe (GRAS).

Similarly, animal products such as "Active CBD Oil Savory Pumpkin Treats" are unapproved new animal drugs, unsafe under section 512(a), adulterated under section 501(a
