FDA WARNING_LETTER - E-Jooce

The FDA Center for Tobacco Products issued a Warning Letter to Alan Peters, operating e-jooce.co.uk, after determining e-liquid products were offered for sale to U.S. customers. An investigation revealed a sale of "Diamond Mist Dragon Mist e-liquid" to a person under 18 years of age, which is a violation of 21 C.F.R. § 1140.14(b). This makes the product misbranded under section 903(a)(7)(B) of the FD&C Act (21 U.S.C. § 387c(a)(7)(B)). The letter emphasizes that e-liquids are "covered tobacco products" subject to FDA jurisdiction. The company must immediately correct this violation and ensure all tobacco products and related advertising comply with the FD&C Act and FDA regulations. Failure to comply may result in civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, and/or injunction. A written response detailing corrective actions and a compliance plan is required within 15 working days.
