FDA WARNING_LETTER - Ever Cat Fuels, LLC - February 25, 2011

An FDA and Minnesota Department of Agriculture inspection of Ever Cat Fuels, LLC, located at 100 Isanti Parkway NE, Isanti, Minnesota, was conducted on February 22 and 25, 2011, following a report to the FDA's Reportable Food Registry regarding an animal feed product labeled "Vegetable Bottoms."

The product was found to be adulterated under section 402(a)(2)(C)(i) of the Federal Food, Drug, and Cosmetic Act (the Act), 21 U.S.C. § 342(a)(2)(C)(i), because it contained deodorizer distillates, an unsafe food additive not authorized by regulation, prior sanction, or GRAS status for animal food.

Additionally, the product was misbranded under section 403(i) of the Act, 21 U.S.C. § 343(i), as its label did not bear the common or usual name of each ingredient, despite being fabricated from two or more ingredients.

The facility also failed to register with the FDA as required by section 415 of the Act, 21 U.S.C. § 350d, which is a prohibited act under section 301(dd) of the Act.
