FDA WARNING_LETTER - Flavor Vapors, LLC/Mob Liquid Labs

The FDA Center for Tobacco Products issued a Warning Letter to Brandi Mazzola and Alexander Mazzola, operators of planeteliquid.com, after a review of their website revealed e-liquid products offered for sale in the U.S. The FDA determined that their "StrawConut Milkshake e-liquid" is a tobacco product under section 201(rr) of the FD&C Act and is misbranded under section 903(a)(7)(B) of the FD&C Act because it was sold to a person younger than 18 years of age.

The violation specifically cites the sale of StrawConut Milkshake e-liquid to a minor, which contravenes 21 C.F.R. § 1140.14(b) prohibiting sales of covered tobacco products, including e-liquids, to individuals under 18. This makes the product misbranded per section 903(a)(7)(B) of the FD&C Act.

The FDA requires immediate correction of this violation and similar issues across all sales and advertising platforms. Failure to comply may result in civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, and/or injunction. A written response detailing corrective actions, including dates of discontinued violative sales and a compliance plan, is required within 15 working days.
