The investigation revealed that the company sold an "Oxbar Astro Maze 50K Disposable Snickerdiddler" ENDS product to a person under the age of 21 through its website. Under the Federal Food, Drug, and Cosmetic Act (FD&C Act), selling tobacco or nicotine products to anyone under the legal age of 21 is prohibited, and products sold in violation of this requirement are classified as misbranded. The FDA further emphasized that all electronic nicotine products fall under its regulatory jurisdiction regardless of the nicotine source. The company was also reminded that new tobacco products require specific federal authorization to be legally marketed in the United States.
