Hina Singh Enterprises, Inc. d/b/a Just Eliquids Distro Inc. – FDA Warning Letter, Jul 20, 2020

The FDA issued a Warning Letter to Hina Singh and Nick Trivedi concerning their website, justeliquids.com, which offers unauthorized electronic nicotine delivery system (ENDS) products for sale in the U.S. The FDA determined that products such as Salteez Pods – Blue Razz Gummy and Juice Man USA E-Juice – Cherry Lime Cola are "new tobacco products" under section 910(a) of the FD&C Act, as they were not commercially marketed before February 15, 2007. These products lack the required premarket marketing authorization orders. Consequently, they are deemed adulterated under section 902(6)(A) and misbranded under section 903(a)(6) of the FD&C Act due to the absence of required information under section 905(j). The FDA also expressed particular concern about the Juice Man USA E-Juice – Cherry Lime Cola product, noting its packaging appears to imitate food products appealing to children, raising concerns about youth appeal and use of ENDS. The letter mandates prompt correction of all violations, discontinuation of violative sales and advertising, and submission of a written response within 15 working days detailing corrective actions and a compliance plan. Failure to comply may lead to further regulatory action, including detention and refusal of admission for imported products.
