The FDA Center for Tobacco Products issued a Warning Letter to Junyuan Liu following a review of the website http://www.cheapcigarettes-store.com, which offers smokeless tobacco products for sale in the United States. The FDA determined that Copenhagen Fine Cut Regular and Copenhagen Pouches are misbranded under sections 903(a)(1) and/or 903(a)(7)(A) of the FD&C Act (21 U.S.C. § 387c(a)(1) and § 387c(a)(7)(A)). This misbranding is due to the website's failure to include any of the health warning label statements required by Section 3(b) of the Comprehensive Smokeless Tobacco Health Education Act of 1986 (15 U.S.C. § 4402) for advertisements of smokeless tobacco products. The letter also reminded the recipient of the requirement for quarterly rotation of warning label statements on advertising. The company must immediately correct these violations and ensure all tobacco products and related labeling/advertising comply with the FD&C Act and FDA regulations. A written response detailing corrective actions, dates of discontinuance, and a compliance plan must be submitted within 15 working days. Failure to comply could lead to severe enforcement actions, including civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, or injunction, and detention of imported products.
