The FDA Center for Tobacco Products issued a Warning Letter to Mr. Lesley regarding violations found on his website, http://www.cigarsunlimited.co.uk, which distributes tobacco products to U.S. customers.

The FDA determined that "Auld Kendal Golden Blend Hand Rolling Tobacco" products, described as "mild," are modified risk tobacco products sold without an FDA order, making them adulterated under section 902(8) of the FD&C Act.

Additionally, "Auld Kendal" flavored cigarette tobacco and/or roll-your-own tobacco products (Coconut, Blueberry, Peach, Black Cherry, Vanilla) are adulterated under section 902(5) of the FD&C Act for containing characterizing flavors, which is prohibited. If they do not contain these flavors, they are misbranded under sections 903(a)(1) or 903(a)(7)(A) for false or misleading labeling/advertising.

Furthermore, "Oliver Twist Chewing Tobacco" smokeless tobacco products (Royal, Original, Eucalyptus, Arctic, Tropical) are misbranded under sections 903(a)(1) and/or 903(a)(7)(A) because their advertisements on the website lack required health warning statements, violating the Smokeless Tobacco Act.
