The FDA's Center for Tobacco Products reviewed the website http://www.discount-cigarettes-online.biz and determined that cigarette products offered for sale to U.S. customers are tobacco products under section 201(rr) of the FD&C Act. Specifically, Kiss Super Slims Fresh Apple and Richmond Cherry cigarettes were identified.

These products are deemed adulterated under section 902(5) of the FD&C Act or misbranded under section 903(a)(1) of the FD&C Act. The violation stems from section 907(a)(1)(A) of the FD&C Act, which prohibits cigarettes from containing artificial or natural flavors (other than tobacco or menthol) that are characterizing flavors. Since September 22, 2009, such flavored cigarettes marketed in the U.S. are considered adulterated. If the products do not contain a characterizing flavor, they are misbranded because their labeling falsely represents them as having apple and cherry characterizing flavors.

The company must immediately correct these violations and ensure all tobacco products on their website, and any other owned or controlled websites, comply with the FD&C Act. Failure to comply may result in FDA initiating further actions, including civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, and/or injunction.
