LDA Industries, LLC d/b/a Vapor Dynamix – FDA Warning Letter, Aug 18, 2020

On July 31, 2020, the FDA issued a Warning Letter to Latisha Adams of Vapor Dynamix, located at 1502 W. Chickasaw Ave, Ste 3, Sallisaw, OK 74955. The letter stemmed from a review of the website https://vapordynamix.com, which revealed that e-liquid products manufactured, advertised, and sold by Vapor Dynamix are misbranded.

The FDA determined that several e-liquid products, including "Vapor Dynamix Butterscotch," "245 Smoke Juice Island Punch," "Farm Fresh Lemon Meringue Pie," and "Southern Tradition Vapor Grannie’s Cookies," are misbranded under sections 903(a)(7)(B) and 903(a)(7)(A) of the FD&C Act (21 U.S.C. § 387c(a)(7)(B) and § 387c(a)(7)(A)). This is because their website advertising fails to include the required nicotine warning statement: "WARNING: This product contains nicotine. Nicotine is an addictive chemical," as mandated by 21 CFR 1143.3(b). The absence of this warning also renders the advertising misleading, contributing to the misbranding.
