Ming's Food, Inc. – FDA Warning Letter, Jun 3, 2011

The FDA conducted an inspection of a food warehouse and processing facility at 5697 New Peachtree Road, Chamblee, Georgia, from May 23, 2011, to June 3, 2011. The inspection revealed serious violations of the Current Good Manufacturing Practice (CGMP) regulation for foods (21 CFR Part 110), causing food products to be adulterated under section 402(a)(4) of the Federal Food, Drug, and Cosmetic Act (the Act) due to insanitary conditions.

Significant CGMP violations included: 1. Failure to exclude pests and protect against contamination (21 CFR 110.35(c)), evidenced by numerous rodent excreta pellets, urine stains, gnawed material, and rodent hairs found on food products and throughout the facility. 2. Failure to hold raw materials to protect against contamination (21 CFR 110.80(a)(5)), specifically cabbage touching a wet cooler floor. 3. Employees failing to wear suitable outer garments (21 CFR 110.10(b)(1)), with noodle room employees preparing egg roll skins without aprons, hairnets, or beard covers. 4. Restroom doors opening into food exposure areas without adequate protection (21 CFR 110.37(d)(4)). 5. Failure to properly store equipment
