MMT Cattle Incorporated – FDA Warning Letter, Oct 15, 2014
On October 8 and 15, 2014, the FDA investigated MMT Cattle, Inc. in Fonda, New York, and found violations of the Federal Food, Drug, and Cosmetic Act. The company offered for sale an adulterated animal for slaughter. Specifically, a bob veal calf sold on June 3, 2014, and slaughtered on June 4, 2014, contained lincomycin residue in its kidney tissue, for which FDA has no established tolerance (21 C.F.R. 556.360). This violates section 402(a)(2)(C)(ii) of the FD&C Act, deeming the food adulterated due to an unsafe new animal drug.
Furthermore, the investigation revealed insanitary conditions, violating section 402(a)(4) of the FD&C Act. MMT Cattle, Inc. failed to maintain complete treatment records, did not identify animals transported for sale at auction, and held expired drugs in inventory, increasing the likelihood of medicated animals with harmful residues entering the food supply.
MMT Cattle, Inc. is responsible for ensuring compliance and must take prompt action to correct these violations and prevent recurrence. Failure to do so may result in regulatory actions like seizure or injunction. A written response detailing corrective steps and timelines is required within fifteen working days of receiving the letter, sent to LCDR Kristen C. Jackson.
