FDA WARNING_LETTER - Rash Catering Services, LLC - February 22, 2024

On February 21-22, 2024, and remotely on March 30-31, 2023, the FDA inspected Rash Catering Services LLC for compliance with the Foreign Supplier Verification Program (FSVP) regulation (21 CFR part 1, subpart L). The inspection revealed significant violations, specifically that the company failed to develop, maintain, and follow an FSVP for imported foods including Yam Flour, Plantain Flour, and Biscuits, as required by 21 CFR 1.502(a). The company also stated they did not know the actual manufacturers of their imported products, despite a manufacturer being declared at entry.

The FDA noted the company might qualify as a "very small importer" under 21 CFR 1.500, which has modified requirements, but still necessitates documenting this status and obtaining written assurances from foreign suppliers. Failure to address these violations could lead to refusal of admission for imported foods under section 801(a)(3) of the FD&C Act, and potential detention without physical examination (DWPE). Additionally, the letter commented that if the company imports seafood, it must comply with the seafood Hazard Analysis and Critical Control Point (HACCP) regulation (21 CFR Part 123). Rash Catering Services LLC must respond in writing within fifteen working days, detailing corrective actions and providing supporting documentation.
