RTS LEASING, LLC – FDA Warning Letter

The FDA Center for Tobacco Products issued a Warning Letter to Randy Slabey regarding RTS Vapes, specifically their website http://www.rtsvape.com. The FDA determined that RTS Vapes Flavorless Nicotine Liquid, an e-liquid product, is a tobacco product under the FD&C Act.

The primary violation identified is the sale of RTS Vapes Flavorless Nicotine Liquid to a person younger than 18 years of age, which constitutes misbranding under section 903(a)(7)(B) of the FD&C Act (21 U.S.C. § 387c(a)(7)(B)). This violates 21 C.F.R. § 1140.14(b), which prohibits retailers from selling covered tobacco products to individuals under 18. The product is deemed a "covered tobacco product" under 21 C.F.R. § 1100.2.

RTS Vapes is required to immediately correct this violation and any similar non-compliance. They must ensure all tobacco products, labeling, and advertising across all platforms comply with the FD&C Act and FDA regulations.
