FDA WARNING_LETTER - The Local Vapory LLC d/b/a The Vapory LLC - June 22, 2023

The FDA's Center for Tobacco Products issued a Warning Letter to Chaz Betts on June 16, 2023, following a review of the website https://thelocalvapory.com. The review determined that electronic nicotine delivery system (ENDS) products were offered for sale or distribution to U.S. customers.

The FDA cited that these products, including "Elf Bar BC5000 Disposable – Sour Candy" and "Esco Bar 2500 Mesh Disposable – Banana Ice," are "new tobacco products" as defined by section 910(a) of the FD&C Act (21 U.S.C. § 387j(a)), because they were not commercially marketed in the U.S. as of February 15, 2007. These products lack the required premarket authorization order under section 910(c)(1)(A)(i) of the FD&C Act.

Consequently, these ENDS products are deemed adulterated under section 902(6)(A) and misbranded under section 903(a)(6) of the FD&C Act, as no required notice or information was provided under section 905(j). The letter emphasizes that all new tobacco products without statutory premarket authorization are unlawfully marketed and subject to enforcement.
