FDA WARNING_LETTER - The-Vape-Place LLC - March 04, 2019

On March 4, 2019, the FDA issued a Warning Letter to The-Vape-Place LLC, specifically addressing Gordon Tinsley and Angie Tinsley, following a review of their website, https://the-vape-place.com. The FDA determined that numerous e-liquid products manufactured, advertised, and sold by The-Vape-Place LLC are misbranded tobacco products.

The core violation is the failure to include the required nicotine warning statement, "WARNING: This product contains nicotine. Nicotine is an addictive chemical," on the labeling and/or advertising for 50 specific e-liquid products listed in the letter. This violates 21 C.F.R. § 1143.3(a) and/or 21 C.F.R. § 1143.3(b). Consequently, these products are misbranded under sections 903(a)(7)(B), 903(a)(1), and/or 903(a)(7)(A) of the FD&C Act (21 U.S.C. § 387c(a)(7)(B), 387c(a)(1), and/or 387c(a)(7)(A)).

The FDA requires immediate corrective action, including discontinuing the violative labeling, advertising, sale, and distribution of these products
