The Vaping Tiger, LLC – FDA Warning Letter, Oct 7, 2021

The FDA issued a Warning Letter to The Vaping Tiger, LLC, following a review of submissions and inspection records, determining the company manufactures and distributes e-liquid products without required marketing authorization. These e-liquid products are deemed "tobacco products" under section 201(rr) of the FD&C Act and are subject to FDA jurisdiction.

The violations include manufacturing, selling, and/or distributing new tobacco products without a marketing authorization order, specifically citing "TIGER AIDE BATON BLEU JOLLY 3MG 30ML," "TIGER AIDE BERRIES ON THE WATER 3MG 30ML," and "TIGER AIDE BLACK WIDOW 3MG 30ML." These products are considered "new tobacco products" as they were not commercially marketed in the U.S. as of February 15, 2007, and lack FDA marketing authorization.

Consequently, these products are adulterated under section 902(6)(A) and misbranded under section 903(a)(6) of the FD&C Act, as required information under section 905(j) was not provided. The failure to provide such reports is a prohibited act under section 301(p).
