FDA WARNING_LETTER - U-Can Food Trading, Inc. - November 30, 2022

On January 23, 2023, the FDA issued a Warning Letter to U-Can Food Trading Inc., a seafood importer located at 1620 N. Indiana Street, Los Angeles, CA. The letter followed an inspection on November 30, 2022, which revealed serious violations of the seafood Hazard Analysis and Critical Control Point (HACCP) regulation, 21 CFR Part 123.

Specifically, the firm failed to comply with 21 CFR 123.12(a)(2) by not having or implementing written verification procedures, product specifications, and an affirmative step to ensure imported fish and fishery products meet Seafood HACCP regulations. As a result, imported Jellyfish products (salted Jelly Fish whole, salted Jelly Fish shredded, and salted Jelly Fish head) and Shrimp Paste were deemed adulterated under Section 402(a)(4) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. § 342(a)(4)), indicating preparation, packing, or holding under insanitary conditions.

The firm's response to the Form FDA 483 was deemed inadequate. The FDA warned that further action could include refusing admission of products under Section 801(a) of the Act, placing products on "detention without physical examination," seizure, and/or injunction.
