FDA WARNING_LETTER - Vapor Kings - June 30, 2020

This FDA Warning Letter, dated June 19, 2020, addresses Vapor Kings (vaporkings.com.au) for violations related to the advertising and sale of e-liquids to U.S. customers. The FDA determined that e-liquids are tobacco products under the FD&C Act.

Two primary violations were identified: 1. **Sales to Minors:** Vapor Kings sold "Blueberry Raspberry Lemon E-Juice" to a person under 18 years of age, violating 21 C.F.R. § 1140.14(b). This renders the product misbranded under section 903(a)(7)(B) of the FD&C Act. 2. **Failure to Include Required Nicotine Warning Statement:** Advertising for several e-liquid products, including "Blueberry Raspberry Lemon E-Juice," "Strawberry Jam Monster E-Liquid," and "Grape Jam Monster E-Liquid," on the website lacked the mandatory nicotine warning statement ("WARNING: This product contains nicotine. Nicotine is an addictive chemical.") as required by 21 C.F.R. § 1143.3(b). This also results in the products being misbranded under section 903(a)(7)(B) of the FD&C Act.
