FDA WARNING_LETTER - Verdict Brands, LLC d/b/a Verdict Vapors, LLC - November 30, 2021

The FDA Center for Tobacco Products issued a Warning Letter to Daniel Prosser of Verdict Vapors, LLC on November 24, 2021, following a review of their website, https://www.verdictvapors.com. The review determined that e-liquid products, including MEGA Crumb Apple, MINTS Chocomint, Verdict Rainbow Cookies 2.0, and MEGA Watermelon Rush, were manufactured and offered for sale or distribution in the U.S.

These e-liquid products are classified as "new tobacco products" under section 201(rr) of the FD&C Act because they were not commercially marketed in the U.S. as of February 15, 2007. The FDA found that these products lacked the required premarket authorization order under section 910(c)(1)(A)(i) of the FD&C Act, rendering them adulterated under section 902(6)(A) and misbranded under section 903(a)(6).

Verdict Vapors is a registered manufacturer with over 430 products listed with FDA. A Premarket Tobacco Product Application (PMTA) (STN PM0001095) submitted on September 5, 2020, resulted in a Refuse to Accept determination on October 29, 2020, for 2 products, and a Marketing
