The FDA's Center for Tobacco Products issued a Warning Letter to Scott Silverman regarding the website https://www.ejuicedb.com, which offers electronic nicotine delivery system (ENDS) and e-liquid products for sale in the U.S. These products are classified as tobacco products under section 201(rr) of the FD&C Act, including those containing nicotine from any source, due to recent legislative amendments.

The FDA determined that several ENDS and e-liquid products listed on the website are "new tobacco products" that lack the required premarket authorization order, making them adulterated under section 902(6)(A) and misbranded under section 903(a)(6) of the FD&C Act. Specific products cited include various disposable vapes (e.g., Snowwolf Ease, Lost Mary Elf Bar OS5000) and e-liquids (e.g., Cracked Berries and Milk by Lady Boss Vapor E-Liquid).

The FDA expressed particular concern that the labeling and/or advertising for some products (e.g., Snowwolf Ease, Glamee Dice 6000) imitate beverage containers and children’s toys, potentially promoting youth use and concealing the products' nature as tobacco products.
