FDA WARNING_LETTER - Wabash Cigar Store, Inc.

The FDA Center for Tobacco Products reviewed Wabash Cigar's website, wabash-cigar.com, and found multiple violations of the Federal Food, Drug, and Cosmetic Act (FD&C Act) related to the sale of smokeless, cigarette, and roll-your-own tobacco products.

The company is selling "pipe tobacco" products (Buoy, Gambler, Golden Harvest, JPS, Largo, OHM, Red Cap) under a "Dual Purpose" heading, promoting them for use in cigarettes, thus classifying them as cigarette tobacco and/or roll-your-own tobacco under the FD&C Act.

Several products, including JPS Pipe Tobacco "JPS LIGHT" and OHM Blue "OHM MILD," are labeled with "light" or "mild" descriptors, making them modified risk tobacco products. These are adulterated under section 902(8) of the FD&C Act because they are sold without an FDA order.

Additionally, flavored cigarette tobacco and/or roll-your-own tobacco products (Buoy Mint, Gambler Mint, Golden Harvest Mint, Largo Mint, OHM Mint, Red Cap Black Cherry, Red Cap Whiskey) are offered for sale. These are adulterated under section 902(5) of the FD&C Act for containing characterizing flavors other than tobacco or menthol.
