FDA WARNING_LETTER - WashingtonsLastFrontier.Com - May 05, 2020

On May 7, 2020, the FDA and FTC issued a Warning Letter to www.washingtonslastfrontier.com for promoting unapproved and misbranded products related to COVID-19. The website, participating in the Amazon Associates program, earned commissions by promoting essential oils and dietary supplements with claims implying they could mitigate, prevent, treat, diagnose, or cure COVID-19.

These claims caused the products to be unapproved new drugs under Section 505(a) of the FD&C Act (21 U.S.C. § 355(a)) and misbranded drugs under Section 502 (21 U.S.C. § 352). Introducing or delivering these products into interstate commerce is prohibited under Sections 301(a) and (d) (21 U.S.C. § 331(a) and (d)), and misbranding while held for sale after interstate shipment is prohibited under Section 301(k) (21 U.S.C. § 331(k)).

The FDA requested immediate cessation of promoting and participating in the sale of such products. The FTC stated that advertising products to prevent, treat, or cure human disease requires competent and reliable scientific evidence, which is lacking for these COVID-19 claims.
