FDA WARNING_LETTER - www.alstobacco.com

The FDA Center for Tobacco Products reviewed Al's Tobacco LLC's website, alstobacco.com, and determined that their smokeless tobacco products are promoted for sale in the U.S. These products, including Camel Snus, Grizzly, Skoal, and Timber Wolf varieties, are classified as tobacco products under the FD&C Act.

The FDA found that Al's Tobacco LLC's smokeless tobacco products are misbranded under section 903(a)(7)(A) of the FD&C Act because their advertisements fail to include the required health warning statements mandated by section 3 of the Comprehensive Smokeless Tobacco Health Education Act of 1986, as amended. Specifically, the advertisements for products like Camel Snus Frost and Grizzly Long Cut Straight did not display any of the four required warnings: "WARNING: This product can cause mouth cancer," "WARNING: This product can cause gum disease and tooth loss," "WARNING: This product is not a safe alternative to cigarettes," or "WARNING: Smokeless tobacco is addictive." The letter also noted the requirement for quarterly rotation of warning labels on advertisements, per section 3(b)(3) of the Smokeless Tobacco Act.

Al's Tobacco LLC is required to immediately correct these violations and ensure all tobacco products and promotional materials comply with the FD&C Act. Failure to comply may result in civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure
