The FDA's Center for Tobacco Products issued a Warning Letter to http://www.cheapcigarette4you.com after reviewing their website and determining that cigarette products offered for sale to U.S. customers are tobacco products under section 201(rr) of the FD&C Act. The FDA found several products to be adulterated under section 902(5) or misbranded under section 903(a)(1) or 903(a)(7)(A) of the FD&C Act.

Specifically, the website offered "Dji Sam Soe Kretek Super Premium" (clove), "Dji Sam Soe Kretek" (clove), "Gudang Garam Surya 12" (clove), and "Sampoerna A Mild" (clove) cigarettes, which are purported to contain a characterizing flavor. This violates section 907(a)(1)(A) of the FD&C Act, which prohibits cigarettes from containing artificial or natural flavors (other than tobacco or menthol) that are characterizing flavors. As of September 22, 2009, such products are adulterated. If these cigarettes do not contain a characterizing flavor, they are misbranded because their labeling or advertising is false or misleading.
