FDA WARNING_LETTER - www.cheapcigarettes.co.za

The FDA Center for Tobacco Products issued a Warning Letter after reviewing websites (cheap-cigarettes.co.za, cigarette.co.za, buy-cigarettes-online.co.za, discount-cigarettes.co.za) offering cigarette products for sale to U.S. customers. These products are subject to FDA jurisdiction as tobacco products.

The FDA determined several cigarette products are adulterated under section 902(8) of the FD&C Act because they are "modified risk tobacco products" sold without an FDA order. Specifically, products like "Dunhill Lights (blue)" and "L D Liggett Ducat – Blue [lights]" use descriptors such as "Lights," qualifying them as modified risk tobacco products under section 911(b)(2)(A)(ii). Selling these without a section 911(g) FDA order constitutes adulteration.

Additionally, products like "Rothmans Mints," "Sobranie Mint," and "Sobranie Slims Mint" are offered for sale, purporting to contain a characterizing flavor. If these products indeed contain such flavors (other than tobacco or menthol), they violate section 907(a)(1)(A) of the FD&C Act.
