The FDA's Center for Tobacco Products reviewed http://www.cheapcigarettessite.com and found cigarette products offered for sale in the U.S. These products are subject to FDA jurisdiction under the FD&C Act.

The FDA determined several cigarette products are adulterated under section 902(8) of the FD&C Act because they are modified risk tobacco products sold without an FDA order. Specifically, products like Kiss Dessert (mini) ("light"), Kiss Super Slims Dream 100s ("light"), Magna Balanced Blue ("light"), Richmond Masculine Super Slims 100s ("milder"), and others use descriptors such as "light" or "milder." Under section 911(b)(2)(A)(ii) of the FD&C Act, such descriptors classify these as modified risk tobacco products.

Section 911(a) of the FD&C Act prohibits introducing modified risk tobacco products into interstate commerce without an FDA order under section 911(g). Since these products are sold without the required FDA order, they are adulterated.

The letter requires immediate correction of these violations and similar ones, ensuring all tobacco products and related advertising comply with the FD&C Act.
