The FDA's Center for Tobacco Products reviewed http://www.cheapcigarettesusa.com and http://www.cheapcigaretteoutlet.com, determining that cigarette products offered for sale are subject to FDA jurisdiction. The review identified several cigarette products, including Aroma Rich Apple, Kiss Mini Mohito, and Richmond Cherry, purported to contain artificial or natural characterizing flavors.

These products violate Section 907(a)(1)(A) of the FD&C Act, which prohibits cigarettes from containing characterizing flavors other than tobacco or menthol. Consequently, these flavored cigarettes are deemed adulterated under Section 902(5) of the FD&C Act. If these products do not contain a characterizing flavor, they are misbranded under Section 903(a)(1) or 903(a)(7)(A) due to false or misleading labeling/advertising.

The FDA requires immediate correction of these violations and similar issues across all websites and advertising media. Failure to comply may result in civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, and/or injunction. Adulterated and misbranded tobacco products imported into the U.S. are subject to detention. A written response detailing corrective actions, including discontinuation dates and a compliance plan, is required within 15 working days.
