The FDA identified two primary categories of violations. First, the firm sells or distributes "modified risk tobacco products," specifically cigarettes labeled with descriptors like "light" or "ultra light," without an FDA order in effect under section 911(g) of the FD&C Act. This renders these products adulterated under section 902(8) of the FD&C Act. Second, the website offers flavored cigarette products, such as "Aroma Rich Apple" or "Richmond Cherry," which purport to contain artificial or natural characterizing flavors (other than tobacco or menthol). These products are adulterated under section 902(5) of the FD&C Act, violating section 907(a)(1)(A). Alternatively, if these products do not actually contain the advertised characterizing flavors, their labeling or advertising is considered false or misleading, making them misbranded under sections 903(a)(1) or 903(a)(7)(A) of the FD&C Act. The FDA requires immediate correction of all referenced violations and similar issues, discontinuation of violative promotion, advertising, sale, and distribution, and submission of a written response within 15 working days detailing corrective actions and a compliance plan. Failure to comply may result in further enforcement actions, including civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, or injunction.
