Firstly, numerous products, including "Bond Special Selection," "Camel Blue," and "Marlboro Gold," are promoted as "Lights" or "Ultra Lights." These descriptors classify them as "modified risk tobacco products" under section 911(b)(2)(A)(ii) of the FD&C Act. Introducing or delivering such products into interstate commerce without an FDA order is prohibited by section 911(a) and renders them adulterated under section 902(8) of the FD&C Act.

Secondly, the website offers flavored cigarettes like "Aroma Rich Apple" and "Richmond Cherry," which are purported to contain characterizing flavors. Section 907(a)(1)(A) of the FD&C Act prohibits cigarettes from containing artificial or natural flavors (other than tobacco or menthol) that are characterizing flavors. Products violating this are adulterated under section 902(5). If these products do not contain characterizing flavors, their labeling or advertising is false or misleading, making them misbranded under section 903(a)(1) or 903(a)(7)(A).
