The FDA identified several violations: 1. **Adulterated Modified Risk Tobacco Products:** Numerous products, including "Bond Special Selection," "Marlboro Gold," and "Winston Blue" (Lights Cigarettes), and "Bond Fine Selection," "Marlboro Silver," and "Winston Silver" (Ultra Lights Cigarettes), are promoted using descriptors like "Lights" or "Ultra Lights." Under Section 911(b)(2)(A)(ii) of the FD&C Act, these are considered "modified risk tobacco products." Introducing or delivering such products into interstate commerce without an FDA order under Section 911(g) is prohibited, rendering them adulterated under Section 902(8) of the FD&C Act. 2. **Adulterated Flavored Cigarettes:** Products like "Aroma Rich Apple," "Aroma Rich Rum Cherry," "Kiss Super Slims Fresh Apple 100s," and "Richmond Cherry" are advertised as containing characterizing flavors (other than tobacco or menthol).
