The FDA's Center for Tobacco Products issued a Warning Letter to cigsbrands.com after reviewing their website and determining they offer cigarette products for sale or distribution in the United States. The FDA found multiple violations of the Federal Food, Drug, and Cosmetic Act (FD&C Act).

Firstly, several cigarette products, including "Bond Street Special Selection (Bond Lights (Special Selection))" and "Marlboro (Marlboro Ultra Lights (Silver))", are described using terms like "Light," "Ultra Light," "Super Light," "Extra Light," or "Low." These descriptors classify them as "modified risk tobacco products" under section 911(b)(2)(A)(ii) of the FD&C Act. Selling or distributing such products without an FDA order in effect, as required by section 911(a), renders them adulterated under section 902(8) of the FD&C Act.

Secondly, products like "Aroma Rich Rum & Cherry" and "Kiss Super Slims Fresh Apple 100’s" are offered with purported artificial or natural characterizing flavors. This violates section 907(a)(1)(A) of the FD&C Act, which prohibits characterizing flavors (other than tobacco or menthol) in cigarettes. If these products do not contain such flavors, their labeling or advertising is false or misleading, making them misbranded under section 903(a)(1
