The FDA's Center for Tobacco Products issued a Warning Letter to Discount4cigs.com after reviewing their website and determining that their cigarette products are offered for sale or distributed to customers in the United States. The FDA found that several cigarette products are adulterated under section 902(8) of the FD&C Act because they are modified risk tobacco products sold or distributed without an FDA order. These products use descriptors such as "Lights," "Ultra Lights," "Premium Lights," "Super Lights," or "mild," or claim reduced levels of/exposure to substances (e.g., "decreased tar and nicotine intake," "safer than other brands," "very light on the nicotine content," "removes impurities").

Additionally, several cigarette products are adulterated under section 902(5) or misbranded under section 903(a)(1) or 903(a)(7)(A) of the FD&C Act because they purport to contain a natural or artificial characterizing flavor (e.g., apple, rum & cherry, mojito, strawberry, cherry, mint). The FD&C Act prohibits cigarettes from containing characterizing flavors other than tobacco or menthol.
