The FDA's Center for Tobacco Products reviewed www.smokeonthecheap.com and found cigarette products offered for sale to U.S. customers in violation of the Federal Food, Drug, and Cosmetic Act (FD&C Act).

Several products were deemed adulterated under section 902(8) of the FD&C Act (21 U.S.C. § 387b(8)) because they were promoted as "modified risk tobacco products" without an FDA order. This includes products described as "Lights" or "Ultra Lights," such as "Bond Special Selection," "Marlboro Gold," "Camel Silver," and "Viceroy Silver," which are considered modified risk tobacco products under section 911(b)(2)(A)(ii) of the FD&C Act (21 U.S.C. § 387k(b)(2)(A)(ii)). Introducing such products into interstate commerce without an FDA order under section 911(g) (21 U.S.C. § 387k(g)) is prohibited.

Additionally, products like "Aroma Rich Apple" and "Richmond Cherry" were found to be adulterated under section 902(5) of the FD&C Act (21 U.S.C. § 387b(5)) for containing characterizing flavors (other than tobacco or menthol),
