The FDA's Center for Tobacco Products reviewed smoketobacco.net and found that the website offers cigarette products for sale to U.S. customers that violate the Federal Food, Drug, and Cosmetic Act (FD&C Act).

Several products, including Bond Lights, Camel Lights, Marlboro Lights, and Parliament Extra Lights, are promoted using descriptors like "Lights," "Ultra Lights," "Extra Lights," and "Super Lights." These descriptors classify them as "modified risk tobacco products" under section 911(b)(2)(A)(ii) of the FD&C Act. Since these products are offered without an FDA order under section 911(g), they are adulterated under section 902(8) of the FD&C Act.

Additionally, products like Aroma Rich Apple, Kiss Super Slims Fresh Apple, and Richmond Cherry are advertised as containing characterizing flavors. Section 907(a)(1)(A) of the FD&C Act prohibits cigarettes from containing artificial or natural flavors (other than tobacco or menthol) as characterizing flavors. Therefore, these flavored cigarettes are adulterated under section 902(5) of the FD&C Act. If they do not contain characterizing flavors, their labeling is false and misleading, making them misbranded under section 903(a)(1) of the FD&C Act.
