FDA WARNING_LETTER - www.smokinforfree.com

The FDA Center for Tobacco Products issued a Warning Letter to Smokinforfree.com after reviewing their website and determining that their cigarette products are offered for sale in the U.S. The FDA found the products to be tobacco products under section 201(rr) of the FD&C Act.

Several products are deemed adulterated under section 902(8) of the FD&C Act because they are promoted as modified risk tobacco products without an FDA order. This includes products labeled with descriptors like "Light," "Ultra Light," "Extra Light," and "Super Light," or described as producing reduced smoke, such as "Marlboro Lights (Gold)" and "Virginia Slims" (due to reduced smoke claims). These are considered modified risk tobacco products under section 911(b)(2)(A)(ii) and 911(b)(2)(A)(i) of the FD&C Act, and their introduction into interstate commerce without an FDA order violates section 911(a).

Additionally, the FDA identified flavored cigarettes, including "Aroma Rich Apple" and "Kiss Super Slims Clubnichka 100’s," which are purported to contain characterizing flavors.
