The FDA issued a Warning Letter to the operators of http://www.buy-discount-cigarettes.net and http://www.buy200cigarettes.com, which sell cigarette products to U.S. customers. The FDA identified two main violations of the FD&C Act. First, several products are adulterated under section 902(8) (21 U.S.C. § 387b(8)) for being promoted as modified risk tobacco products without an FDA order. This includes products advertised with descriptors like "Lights," "Super Lights," and "Premium Lights," which classify them as modified risk products under section 911(b)(2) (21 U.S.C. § 387k(b)(2)). Introducing such products without an FDA order violates section 911(a) (21 U.S.C. § 387k(a)). Second, Sobranie Slims Mints 100’s are either adulterated under section 902(5) (21 U.S.C. § 387b(5)) or misbranded under section 903(a)(1) (21 U.S.C. § 387c(a)(1)). This is due to their purported mint characterizing flavor, prohibited for cigarettes under section 907(a)(1)(A) (21 U.S.C. § 387g(a)(1)(A)). If no such flavor exists, the labeling is false. The company must immediately correct these violations and submit a written response within 15 working days detailing corrective actions. Non-compliance could lead to civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, injunction, or refusal of admission for imported products.
