On April 11, 2012, the FDA issued a Warning Letter to Mr. Christ S. King, owner of a dairy operation in Parkesburg, Pennsylvania, following an investigation on March 7, 9, and 22, 2012. The investigation revealed violations of the Federal Food, Drug, and Cosmetic Act (FD&C Act).
Specifically, a bob veal calf sold for slaughter on October 25, 2011, was found to be adulterated. USDA/FSIS analysis of tissue samples from the calf, slaughtered on October 26, 2011, showed sulfamethazine residues of 89.980 ppm in the liver and 72.928 ppm in muscle tissues. This significantly exceeds the FDA tolerance of 0.1 ppm for sulfamethazine in uncooked edible cattle tissues (21 C.F.R. 556.670). Furthermore, no tolerance is established for Sustain III Calf Bolus (sulfamethazine) in calves under one month or on an all-milk diet (21 C.F.R. 520.2260b). This constitutes adulteration under section 402(a)(2)(C)(ii) of the FD&C Act.
