These violations render their shell eggs adulterated under the FD&C Act and in violation of the PHS Act.

Key violations include: 1. **Inadequate SE Prevention Plan (21 CFR 118.4):** * Failure to include practices protecting against cross-contamination when persons move between poultry houses (e.g., footbaths, hand sanitizing), and observed lack of such practices with stray animals and excrement present. * Failure to include and implement measures preventing stray poultry, wild birds, cats, and other animals from entering poultry houses; observed numerous wild birds, nesting, feeding, and leaving excrement, and cattle on manure pits due to lack of barriers. * Failure to prohibit employees from keeping birds at home in the written plan. * Failure to include and implement an appropriate fly monitoring method (e.g., spot cards, Scudder grills, sticky traps) and use appropriate control methods when needed. * Failure to include the requirement that chicks be procured from SE-monitored breeder flocks meeting NPIP "U.S. S. Enteritidis Clean" status.
