FDA WARNING_LETTER - Double B Dairy, LLC - January 20, 2010

On January 14 and 20, 2010, the FDA investigated a dairy operation at 280 West 110 South, Murtaugh, Idaho, finding violations of the Federal Food, Drug, and Cosmetic Act. A dairy cow sold for slaughter on September 17, 2009, contained Flunixin at 1.494 ppm in the liver, exceeding the 0.125 ppm tolerance (21 CFR 556.286), rendering the food adulterated under section 402(a)(2)(C)(ii) of the Act.

The investigation also revealed insanitary conditions, specifically an inadequate system to prevent medicated animals with harmful drug residues from entering the food supply, violating section 402(a)(4). Deficiencies included failure to maintain records correlating ear tags to back tags for sold animals, leading to lost identity and inability to provide treatment records. Additionally, a cow with back tag (b)(4) was administered Banamine (Flunixin meglumine), but the treatment was not recorded.

The FDA requires prompt corrective action within fifteen working days, including steps taken or planned to correct violations and prevent recurrence. Failure to comply may result in regulatory action such as seizure or injunction. A written response detailing corrective actions and supporting documentation must be submitted to Brenda L. Reihing, Compliance Officer.
