FDA WARNING_LETTER - Jacob Village Farm Corp.

The FDA Center for Tobacco Products issued a Warning Letter to Ms. Shah, affiliated with Village Farm Grocery, for misbranded smokeless tobacco products advertised on multiple websites, including villagefarmgrocery.com. The FDA determined that the websites, which redirect to villagefarmgrocery.com, promote smokeless tobacco products for sale in the U.S. and are subject to FDA jurisdiction under the FD&C Act.

The primary violation is the failure to include required warning label statements in advertisements for smokeless tobacco products, such as Copenhagen, Kodiak, Marlboro Snus, and Skoal Tobacco products. This violates section 903(a)(7)(A) of the FD&C Act and section 3 of the Comprehensive Smokeless Tobacco Health Education Act of 1986, as amended. The required warnings include statements about mouth cancer, gum disease/tooth loss, the product not being a safe alternative to cigarettes, and addictiveness. Additionally, the letter notes the requirement for quarterly rotation of warning label statements on advertising, in accordance with an FDA-approved plan.
