FDA WARNING_LETTER - La Tienda, Inc. - November 20, 2013

On November 20, 2013, the Virginia Department of Agriculture & Consumer Services (VDACS) inspected La Tienda, Inc.'s seafood warehouse in Toano, VA, on behalf of the FDA. The inspection revealed serious violations of the seafood Hazard Analysis and Critical Control Point (HACCP) regulation (21 CFR Part 123), rendering Mojama Dry-Cured Tuna Filets, Nardin Anchovy Filets (unsmoked), and Cantabrian Anchovy Filets adulterated under Section 402(a)(4) of the Federal Food, Drug, and Cosmetic Act.

Key violations included: * Failure to conduct and document a hazard analysis for Mojama Dry-Cured Tuna Filet (21 CFR 123.6(a)). * Absence of a written HACCP plan for Mojama Dry-Cured Tuna Filet (21 CFR 123.6(b)). * HACCP plan for Nardin Anchovy Filet did not identify Clostridium Botulinum and bacterial growth as significant hazards (21 CFR 123.16(c)(2)). * No records of corrective actions taken when the walk-in cooler temperature for Nardin Anchovy Filet surpassed the 40°F critical limit (21 CFR 123.7(d)). * Insufficient frequency of monitoring sanitation conditions
