FDA WARNING_LETTER - Troyer, Todd - August 26, 2008

On July 24, 28, August 1 and 26, 2008, the FDA investigated Todd Troyer's veal operation in London, OH. The investigation found violations of the Federal Food, Drug, and Cosmetic Act.

Specifically, a veal calf sold for slaughter on February 14, 2008, was found to be adulterated. Tissue samples from the slaughtered animal contained 99.30 ppm neomycin in the kidney, exceeding the 7.2 ppm tolerance for cattle, and having no acceptable level for veal calves. Additionally, sulfamethoxazole (0.22 ppm in liver, 0.27 ppm in muscle) and flunixin (0.075 ppm in liver, 0.021 ppm in muscle) were detected, for which no tolerances exist in veal calves. These residues render the food adulterated under section 402(a)(2)(C)(ii) of the Act.

The operation also failed to maintain complete drug treatment records, leading to the adulteration of food under section 402(a)(4) due to insanitary conditions. Furthermore, neomycin, sulfamethoxazole, and flunixin were used in an extralabel manner, violating 21 CFR Part 530.
