FDA WARNING_LETTER - Vaperz Electronic Cigarettes

The FDA Center for Tobacco Products issued a Warning Letter to Vaperz.co.uk after reviewing their website and determining that their e-liquid products, specifically VFlaverz Pineapple e-liquid, are tobacco products subject to FDA jurisdiction. An investigation revealed that the firm sold VFlaverz Pineapple e-liquid to a person younger than 18 years of age. This action constitutes a violation of 21 C.F.R. § 1140.14(b), which prohibits the sale of covered tobacco products to minors. Consequently, the VFlaverz Pineapple e-liquid product is deemed misbranded under section 903(a)(7)(B) of the FD&C Act (21 U.S.C. § 387c(a)(7)(B)), as tobacco products are misbranded if sold in violation of prescribed regulations. The FDA requires Vaperz.co.uk to immediately correct this violation and similar deficiencies, ensuring all tobacco products, labeling, and advertising comply with the FD&C Act and FDA regulations. A written response detailing corrective actions, discontinuation dates, and a compliance plan must be submitted within 15 working days. Failure to comply may lead to severe enforcement actions, including civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, injunction, and detention of imported products.
