The FDA's Center for Tobacco Products reviewed the website http://www.buyonline-cigarettes.com and determined that cigarette products offered for sale to U.S. customers are adulterated. These products are considered tobacco products under section 201(rr) of the FD&C Act.

The violation stems from the sale and distribution of cigarettes described as "Lights," "Ultra lights," "Extra Lights," or "Super Lights" in product labeling or advertising. Examples include "Bond Lights," "Camel Lights," "Marlboro Lights," "Parliament Extra Lights," and "Winston Super Lights." Under section 911(b)(2)(A)(ii) of the FD&C Act, using such descriptors makes these products "modified risk tobacco products."

Section 911(a) of the FD&C Act prohibits the introduction or delivery of modified risk tobacco products into interstate commerce without an FDA order. Since these products are sold without the required FDA order, they are adulterated under section 902(8) of the FD&C Act.

The FDA requires immediate correction of these violations and similar issues to ensure compliance with the FD&C Act. Failure to comply may result in further actions, including civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, and/or injunction.
