Additionally, Kent products are described as having a "triple filter [that] is intended to reduce the negative impact on a smoker’s health," and R1 products claim to "contain the lowest rate of harmful substances," have "minimum nicotine’s," and "reduc[e] the negative impact on your health." These claims represent reduced risk or exposure to substances, classifying them as modified risk tobacco products under section 911(b)(2)(A)(i).

Selling these products without an FDA order renders them adulterated under section 902(8) of the FD&C Act. The FDA requires immediate correction of these violations and similar ones, ensuring all tobacco products and related advertising comply with the FD&C
